The supposed "No Fear" Act, is really the FEAR act!For a few months, I worked in the Marketing Dept. here at JB MDL. But I was fired in retalitation for threatening to file a greivance against my supervisor (Charles "Monty" Dunn). Luckily, I captured this on video, take a look:
More Detail: For a few months, I worked in the Marketing Dept. here at JB MDL. (I have a disability, sleep apnea, which makes it next to impossible for me to keep a normal job with a normal schedule. When I was hired, they said it was ok and they would work with me, but the rest of the "team" shunned me, treated me as an outcast, and with disrespect). But the straw that broke the camel`s back for me, was when I was cheated out of over 3/4 of my pay (instead of 80 hours, I was only paid 18 hours total for the prior 2 weeks), and Monty didn`t even care. So during a meeting in his office, I threatened to file a grievance if this didn`t get fixed. Monty replied "Nobody ever threatens me, you`re done!" and then I was immediately fired a couple days after that.
Ironically, this happened at the exact same time as Col. Hodges issued this bulletin on the Equal Opportunity and Treatment: Col Hodges EOT Policy Letter (2013).pdf Notice how he says: "Additionally, I will not tolerate reprisal against individuals who come forward with complaints of discrimination or harassment". But apparently this was all just meaningless propaganda, because not only did he tolerate it, further he assisted them in sweeping it under the rug.And in all probability, I would never have even received any of the pay I was short changed out of at all, unless I complained to an agency outside of Monty`s circle. After he said "you`re done", I walked out of his office, and for over more than the next hour I had tried talking to different departments on base, from the base legal office, to EEO, then finally to HR, where they had given me a grievance form to fill out. But when I came back to my desk, I overhead Monty on the phone, he was talking to Michelle in HR, the very same lady I had just been talking to minuets before, and whom had given me the grievance form to fill out. I heard Monty laughing with her, and he had said: "Yeah I know, he`s a real character." So then I knew that obviously they were not going to take my grievance seriously.
So then I called the NJ DOL, an agency outside of his control, and I made sure that I spoke loudly enough that Monty overheard me.
Within less than 5 minutes after hearing me on the phone with the NJ DOL, then he called me into his office, told me it was a mistake that I had been cheated out of one full week of my pay, and I could go over there and pick it up.
Then I mentioned to him that I heard him on the phone with Michelle, and I didn`t appreciate him calling me a real character. He replied "How do you know it was you we were talking about?", and then I said there was only one other "he" in our team besides me. He then responded that "You forget who`s in control here".
Look at these 2 pages from Monty`s sworn statements: Monty`s testimony On the first page, he claims that when I told him that I was going to file a grievance, he claims that he replied to me: "That`s your right." Obviously, this is a lie. Also, he admits that I first mentioned my intention to file the grievance on Sep 6th (which he could not deny, as documented by my email to the NJ DOL, and my contact requests with other offices). But he countered that by claiming that he decided to fire me just the day before, on Sep 5th. (Do I need to comment on the obvious here?)
Then on the second page, he denies ever calling me or anyone else a real character, and denies ever making that statement But in the video, on 2 separate occasions, he does deny not saying it, instead his only responses were: "How do you know that we were talking about you?" So again, yet more lies.
The truth is plain to see - I was fired in retaliating for filing the grievance, something that is absolutely illegal, but he did it anyway and he has gotten away with it.
I have tried to do this buy the book, but repeatedly I have deprived any justice at all. First, I had to wait several months for the AF to conduct its own investigation.
To no surprise, they did not find in my favor. Then I had to wait another 6 months after that to go through the informal EEO grievance process.
Once again, no surprise that they too took no action in my favor. So then I finally was able to take this to the formal EEO grievance stage.
I was supposed to wait no more than 6 months total for the formal EEOC process, but even well past 6 months, they still had not even begun the initial phase yet.
Then as a direct result of failures on the parts of the AF and the EEOC, the lazy ALJ at the EEOC wrongfully blamed me for it and then completely dismissed my EEOC complaint. It has been almost 2 years, and now I am so tired of getting jerked and around and outright cheated, I am taking this to the public!The audio quality in these video is not the best.
